1.1 To become a AusVegas
Online Casino Player, you must first of all register. When
registering, you warrant to AusVegas
that:
- You are at least eighteen (18) years of age which is the
legal gambling age in the Northern Territory of Australia;
- The jurisdiction in which you reside or from where you
access the site is not a nominated non-gaming jurisdiction
as set out in section 17 of these terms;
- You have provided an email address that is controlled
solely by yourself; and
- You have provided your true, correct and complete details
on the site registration form.
- You are not physically present in Australia.
1.2 It is your sole responsibility to keep registration
information true, accurate and complete by notifying AusVegas
Customer Support immediately of any change to registration
details by:
- Updating your registered email address under the "Account
Details" section - "Edit Player" Details
page; and/or
- Posting, Emailing or faxing to us a copy of an official
document to support your request to update your registration
details.
- Such documentation will become the property of AusVegas
and will not be returned to you.
1.3 Subject to sections 1.1 and 1.2, AusVegas
will not be held liable for any incorrect information provided
by the Player that may result in the Player sustaining any
loss and/or damages.
1.4 AusVegas reserves the right to
suspend and/or permanently close any account registered
with a User Name that contains inappropriate or offensive
language.
1.5 A registered Player may be classified as a Points or
Cash Player. You may only register one (1) points account
and one (1) cash account at AusVegas.
AusVegas reserves the right to suspend
multiple accounts.
1.6 A Points Player is a Player who elects not to play for
cash and is therefore unable to access any cashier facilities.
1.7 If registering to play for cash, your account will be
categorized as 'Online'. As an Online registered player,
you will not be able to withdraw from your player account
until you have provided an appropriate form of identification
as proof of age and verification of place of residence.
1.8 AusVegas considers a copy of a
valid Driver's Licence, Birth Certificate, Passport or Age
identification card as appropriate proof of age.
1.9 Adequate proof of residential address will be recognized as a copy
of valid Driver's Licence, Utility Bill, Rent Receipt or
Bank Statement.
We are required by law to ask these documents of our players. For further information, including specific details on documents we consider eligible for use in verifying name, date of birth, and residential address, please refer to this link.
1.10 You must provide suitable identification, as specified
in sections 1.8 and 1.9, to AusVegas
within ninety (90) days of registering a cash player account.
If a player does not submit such proof of age identity,
and place of residence, then the Player's account will be
suspended until such time as suitable identification is
received.
1.11 Our acceptance of your registration as a player is
expressly on condition that the Player cannot use the services
of AusVegas if the Player is physically
present in Australia or in a nominated non-gaming jurisdiction.
1.12 If AusVegas reasonably believes
that a Player is withholding information because the Player
may have falsified his/her name, address or age then AusVegas
reserves the right to suspend or permanently close the registered
account.
1.13 Following verification procedures, a Player is classified
as 'Age Confirmed' and is able to make withdrawals from
his/her cash account.
1.14 AusVegas reserves the right at
any time to withdraw its services from a Player if it appears
to AusVegas at any time that the Player
has network data which indicates the Player is physically
in Australia or in a nominated non-gaming jurisdiction.
1.15 Registering a player account at AusVegas
automatically places you on our mailing list. Should you
wish not to receive further promotional or general information
emails in regards to our site simply email support@ausvegas.com.au
and request to be unsubscribed.
1.16 AusVegas reserves the right to telephone players who choose to complete the optional telephone number field on the registration form. From time to time AusVegas staff may telephone a player in matters such as, but not limited to, Marketing/Promotional comments and technical issues, or other reasons as deemed appropriate by AusVegas.
1.17 Players registered at any gaming site/s operated by LCPL may receive email notifications such as but not limited to promotions and general information pertaining to other LCPL sites at which the player has not yet registered. Should players not wish for this to occur they are required to email support requesting to be unsubscribed.
2.1 Upon registering with AusVegas,
you will be required to create a User Name and Password
to be used when next signing onto the site. You will also
be required to create a Security Keyword/s for the purpose
of making cheque withdrawal/s and/or in the event you forget
your password. It is the responsibility of each Player to
keep his/her User Name, Password and Security Keyword/s
confidential.
2.2 Your account is solely for your personal use. Under
no circumstances, may you permit any other person or third
party to access and use your account, User Name, Password
and/or Security Keyword/s, or accept any winnings or prize.
2.3 AusVegas will not be held liable
and you indemnify AusVegas for any
and all claims, losses, damages and/or costs accrued by
the Player where the Player has disclosed his/her User Name,
Password and/or Security Keyword/s to another individual.
2.4 AusVegas strongly recommends players
do not install software that automatically saves/displays
players login details and passwords. AusVegas
will not be held liable where a Player may have third party
software installed which automatically enters a Player's
Password in their AusVegas Account
or where a Player may have his/her Internet Browser configured
to save passwords.
2.5 In the event that you believe your Password or Security
Keyword/s is no longer secure, you should change your password
or Security Keyword/s immediately under the "Account
Details" section - "Change Password" or "Edit
Security Keyword/s" page or notify us via email at
support@ausvegas.com.au,
whereupon you will be provided with full instructions.
2.6 Any wager/s made and accepted at AusVegas
using your User Name and Password will be treated as valid
and binding on you.
3.1 Requirements/Instructions on how to open and use your
AusVegas account are provided in the "Getting
Started" section of our site. In addition
to these requirements, you agree to all the terms contained
herein and to the Player Limits set out in section 5.
3.2 Deposits into Player accounts can be made online using
*VISA, *MasterCard, and through third party payment
providers.
(*Note: Players depositing via credit card must use a card registered in their name
only).
As part of our verification procedures we may deposit a small amount to the credit card you used at our site, to verify that you are the card owner. We ask that you quote the correct amount which appears on your bank statement to our Customer Support staff. We will then upgrade your account in order for you to continue play.
We log IP address details against your credit card deposits, and will prosecute credit card fraud to the full extent of Australian and International Law.
3.3 Deposits into a Player account using third party payment
providers such as, but not limited to, NETeller and FirePay,
will be processed by AusVegas once funds are received
from the third party payment provider, except where other
arrangements have been made with the Player.
3.4 It is your sole responsibility to make yourself aware
of the provisions and terms of agreement stipulated by the
third party payment provider/s. AusVegas is in no
way liable for any losses and/or damages suffered by the
Player arising from any negligence or other default, act
or omission by or on behalf of any third party payment provider/s.
3.5 AusVegas will not transfer any confidential
Player information to the third party providers as per our
Player Privacy
policy.
3.6 Deposits into Player accounts can also be made offline
via cheque, and telegraphic wire transfers. Players must have a registration level of Age
Confirmed to be eligible to use offline deposit methods.
3.7 AusVegas may at their discretion restrict Players
residing in particular jurisdictions from depositing funds
to their Player account via Credit Card or other methods.
Players who reside in these jurisdictions may therefore
deposit to their player account via Telegraphic Transfer
only.
3.8 Each time you make a deposit or place a bet/wager at
AusVegas you warrant that:
- you are over the age of 18 years
- that any financial instrument used by you at AusVegas does not have any additional person under the age
of 18 associated with it
3.9
Only Players with a registration level of Bronze, Silver
and Gold may make withdrawals via third party payment providers,
such as but not limited to FirePay and NETeller.
3.10
Once you have created a cash account at AusVegas and
you have provided suitable proof of age / address identification,
you will receive a PIN code via email, which you will be
required to enter 'once' only, in order to activate the
withdrawal function for your account. Each time you make
'cheque' withdrawals from your player account you
will be required to enter your security keyword/s you created
at the time of registration.
3.11
Winnings are subject to AusVegas verification procedures
before payment. AusVegas may charge a nominal fee
when players choose to make a withdrawal from their AusVegas cash account to cover transactional costs. Players
requesting a stop payment/buy back on a cheque may be charged
a nominal fee.
3.12 AusVegas reserves the right to charge additional
transaction fees where multiple withdrawals (more than 5)
are made within a 24-hour time period.
3.13 Players collecting wins from AusVegas are exempt
from paying tax on prize monies in Australia. AusVegas pays all gaming taxes to the Northern Territory Government
of Australia.
3.14 The minimum withdrawal amount from your casino account is 20 units of the currency of your account. (So, $20 for a USD account, £20 for a GBP account, and €20 for a Euro account.)

4.
Use of Customer Support Facilities
|
|
4.1 To ensure you receive the very best customer service
experience, AusVegas has developed email and chat
facilities for your use. When using our support email and
chat facilities, you agree not to transmit, send or display
content containing any of the following:
- Statements that defame, abuse or threaten AusVegas
staff;
- Tasteless, bigoted or inappropriate remarks;
- Any material that endeavors to sell, solicit or aggravate
AusVegas staff;
- The distribution of unauthorized copyright material including
computer programs, recordings, photos, designs and artwork;
and
- Any material that contains obscene, vulgar or indecent
photographs, images or language.
4.2 Players breaching these terms may be subject to litigation
or prosecution under appropriate law.
4.3 A Player attempting to damage, defame or slander the
reputation of AusVegas will be excluded from the
site indefinitely and their player account suspended or
closed permanently.
4.4 A Customer Care Supervisor has the right to remove a
Player from the support chat facility for any reason without
providing the Player with any reason for the eviction.

5. Player Limits and Registration Levels
|
|
5.1
'Online' registered Players have a default deposit limit
of US$500 per month when depositing to their Player account.
A lower deposit limit may be set if requested. Online
registered Players may not withdraw funds from their player
account until they have provided the appropriate identification
to become Age confirmed (See: Sections 1.8, 1.9 and 1.13).
5.2 'Age Confirmed' Players have a default deposit limit
of US$2,500 per month when depositing to their Player
account. A Player's registration level may be upgraded
to Bronze when confirmation is received that the player
has withdrawn a cheque from their player account and cashed
this cheque at their bank.
5.3 A 'Bronze' Player has a default deposit limit of US$5,000.
Upon request and subject to approval, you may apply for
an increase in this limit.
5.4 Subject to approval, players may be eligible for Silver
or Gold membership status. AusVegas may establish
limits on the amount you may deposit at these levels and
vary such limits from time to time.
5.5 As a responsible gaming operator, AusVegas
has implemented a seven (7) day cooling off period when
increasing a Player's deposit and bet limit. The seven
(7) day cooling off period will commence upon a Player's
application for an increase. For full details, please
refer to the AusVegas Responsible
Gaming Policy that is incorporated by reference
into these Terms.
5.6 AusVegas may at their discretion lower the default deposit limits for players residing in particular jurisdictions.

6.
Account Exclusions, Suspensions & Closures
|
|
6.1 A Player may request to be excluded
or can exclude themselves from the site at anytime. Upon
initiating an exclusion the Player will not be able to play
for the period selected.
6.2 If a Player self excludes three (3) times a permanent
ban will be applied to that player account. This is a restriction
set in place by the Northern Territory Government of Australia
and, therefore, not negotiable unless taken up by the Player
concerned with the Northern Territory Government directly.
6.3 AusVegas, reserves the right to
ban players indefinitely, who have permanently self excluded
themselves, from participating at other Internet gaming
sites operated by Lasseters Casino Pty Ltd (LCPL).
6.4 AusVegas reserves the right to
permanently exclude a Player from the site where the Player
is in breach of these Terms and may at its discretion pay
the balance of the Player's account to the Player where
the Player is not under investigation (refer to section
9.3)
6.5 AusVegas reserves the right to
suspend a Player's account as a result of, but not limited
to the following reasons:
- Too many successive failed "security Keyword/s "
or "password" attempts;
- Deposit reversals;
- Rejected Credit Details;
- Failure to provide and maintain true, accurate and complete
registration details (See: section 1.2);
- Failure to provide sufficient identification (See: sections
1.8, 1.9);
- Inappropriate use of customer support facilities (See:
section 4);
- Compliance with our Responsible Gaming Policy; and/or
- Player misconduct.
6.6 AusVegas reserves the right to
suspend a Player's account indefinitely, if there is a breach
of these Terms of Use.
6.7 AusVegas may place a stop payment
on any funds to be issued to a Player or temporarily place
a suspension on a Player's account, if it considers that
payment of such funds or continuance of the account is affected
by illegality or constitutes an offense at law, or if the
Player is under investigation (refer to section 9.3).
6.8 If you attempt to defraud AusVegas
or any other gaming site operated by Lasseters Casino Pty
Ltd (LCPL), in any way, including without limitation through
the use of credit cards or any other payment method, regardless
of the outcome, or if you fail to honour credit card or
other payment method deposits or "charge back"
any deposit/s made to your account, AusVegas
will undertake the following courses of action:
- We will suspend your account indefinitely;
- All winnings to which you might otherwise be entitled
will be forfeited;
- Refer any charge backs along with
your player details to a debt collection agency;
- We reserve the right to recover any fees from you that
LCPL may be charged from a collection agency; and
- AusVegas reserves the right to issue
common law proceedings against you.
6.9 A suspended account becomes dormant after a period of
183 days. All dormant accounts are considered closed, and
the balance of a Player's account will be withdrawn by AusVegas.
The Player is entitled to apply to have these funds returned
to them if application occurs within five years of the date
on which the account becomes dormant.
6.10 In the event of a Player's death, the balance of the
Player's account or any prizes arising from entry into a
promotion/competition will automatically form part of the
deceased Player's estate. AusVegas
will request the claimant to supply a copy of the death
certificate and a certified copy of proof of entitlement
such as a grant of probate of the will and final testament.
7.1
If a Player fails to finish a multi-state game before
signing out of the site, that player is to complete that
game when they next sign in. A Player will not be able
to play another game until the unfinished game is completed.
7.2 If a Player fails to complete an unfinished game within
183 days, the account is considered dormant and will result
in the wager amount being forfeited to the NT Government
of Australia. The Player is entitled to apply to the NT
Government to have these funds returned to them if application
occurs within five years of the date on which the account
becomes dormant.
7.3 Subject to 7.2, the AusVegas system will terminate
all unfinished games after 183 days has elapsed.

8.
Promotions/Competitions
|
|
8.1 AusVegas may promote
its Internet gaming service via promotions/competitions,
to which entrants must be at least 18 years of age and must
not reside in a nominated non-gaming jurisdiction as set
out in section 17.
8.2 AusVegas reserves
the right to withdraw promotional funds from a player account
if these funds have not been bet/wagered within 14 days
of receipt.
8.3 For full details, please refer to the Promotions/Competitions
Terms & Conditions incorporated by reference into
these Terms of Use.
9.1
The Australian Federal Government's National Privacy principles
are set out in the 'Privacy Act' 1988 (Cth). AusVegas is committed to protecting Player privacy by acting
in accordance with the requirements of the Act. For full
details, please refer to the AusVegas Privacy
Policy that is incorporated by reference into
these Terms.
9.2 The AusVegas Privacy Policy provides that we will not sell, rent or distribute a Player's personal information to a third party.
9.3 Section 9.2 will not apply where, subject to section
40 'Investigations' of the 'Privacy Act' 1988 Cth, a Player
is under official investigation by any government, judicial,
or state authorized regulating body for reasons of fraud,
terrorist activity, money laundering or any other illegal,
illicit, criminal activity.
9.4 Sharing of Player information - LCPL reserves the right to cross reference player information between its Online Gaming entities as set out in the Privacy Policy. By accepting the Privacy
Policy and Terms you consent to the use of your personally identifiable information in the manner described in the AusVegas Privacy Policy.
AusVegas may share your personal data with our Regulators (Northern Territory Government of Australia) when permitted to do so and other Government agencies in order to comply with our obligations under Australia's anti-money laundering and counter-terrorism financing (AML/CTF) Acts.
AusVegas does not warrant or suggest that Internet gaming
or any such Trade Lotteries comply with the legal requirements
of any jurisdiction other than the Northern Territory
of Australia. It is the sole responsibility of the player
to satisfy his/herself of the legal requirements within
that jurisdiction.

11.
Advertising Legal Restrictions
|
|
Where the law of any jurisdiction outside of
the Northern Territory prohibits AusVegas
from advertising gambling, this site is not intended to act as
an advertisement in that jurisdiction. A person residing within
a nominated non-gaming jurisdiction (See: section 17) should immediately
cease and desist their inspection of such material.
12.1 All AusVegas games are conducted under Government
approval. All Players agree to submit to the jurisdiction
of the courts of the Northern Territory of Australia and
to all Australian courts of higher appellate jurisdiction
in respect of all matters arising pertaining to the AusVegas Terms of Use and Policies.
12.2 If a claim for a gaming win is made by a
claimant within 5 years of the end of the game, AusVegas will immediately attempt to resolve the claim.
12.3 If AusVegas is unable to resolve the claim,
the claimant will be notified by email of the decision
and be further advised that they are entitled to apply
to, the Director of Gaming Northern Territory Government
for a review of the decision within 10 days of receiving
such notice.
12.4 If a request is made to the Director, the Director
may carry out investigations considered necessary to resolve
matters in the dispute and must determine whether the
prize or gaming win is to be given to the claimant or
not.
12.5 Entitlement to a gaming win lapses if not
claimed within 5 years. If a gaming win is not
claimed within 5 years after the end of the game in which
the gaming win was won, the entitlement to the
gaming win is extinguished.
13.1
All content on the site is for personal, non-commercial
use only. Players must not use the site or AusVegas
support chat facility to deal in securities, conduct any
business or illegal activity. If a Player is found to
be using the AusVegas site for any reason other
than that of personal use, AusVegas will close
the account of the Player and ban their future use of
the site.
13.2 Content on the site is not to be reproduced or distributed
without the prior written consent of AusVegas.
AusVegas own the copyright in all content on the
site. Anyone found using a AusVegas registered
trademark or any of the copyright content at this site
without prior written consent from AusVegas may
be subject to litigation.
13.3 While considerable care has been taken in compiling
and updating content on the site, AusVegas does
not guarantee the accuracy of such content. To the extent
permitted by law, AusVegas excludes all warranties
in relation to the content and is not liable for any damage,
loss, cost or expense incurred by any person using the
site.
13.4 You will not violate or attempt to violate the security
of AusVegas and you must not hack into AusVegas, the computer systems that support it or the computer
systems of others users of AusVegas. Hacking means
unauthorized access, malicious damage and/or interference
and includes, without limitation, mail bombing, propagating
viruses, worms or other types of malicious programs, deliberate
attempts to overload a computer system, broadcast attacks
or any other method designed to damage or interfere with
the operation of a computer system or website.
13.5 Subject to Government approval AusVegas reserves
the right to withdraw a game from the site indefinitely
at any time with/without notice.
13.6 AusVegas may at its sole discretion make
changes to the pay tables/rates applying to the AusVegas games. It is the player's responsibility to be
aware of the payout rate applying to each game before
choosing to place a bet/wager on that game.
14.1
The AusVegas site contains links to other sites
not operated by AusVegas. AusVegas does
not control those sites and cannot be held responsible
for their content. Providing such links is not intended
as an endorsement of any goods, services, policies or
content on those sites.
14.2 AusVegas will not be liable for any damages,
losses (or other) to players that may be experienced due
to usage of these sites.
AusVegas cannot and does not guarantee that files available
for downloading through the site will be free of viruses,
or other codes that may corrupt or destruct properties.
A patron is solely responsible for implementing sufficient
procedures and accuracy of data input and output, and
for maintaining a means external to the site for the reconstruction
of any lost data.
16.1
AusVegas does not receive or take commissions
on any credit card transaction. An exchange rate will
be applied to players using credit cards to deposit funds
into their Player accounts. The rate applied may vary
depending on the card type used, and is dictated solely
by the Player's Credit Card company.
16.2 For Players utilising alternative payment methods
to deposit funds, AusVegas will apply the daily
exchange rate as advised by our bank plus a nominal charge
to cover transactional costs.

17.
Restricted Jurisdictions
|
|
17.1
AusVegas is not liable under the law of any Jurisdiction,
other than the Northern Territory Government of Australia.
17.2 Under the Interactive Gambling Act 2001, players who are physically present in Australia are prohibited from creating a Points and/or Cash account/s at AusVegas.
17.3 AusVegas reserves the right to monitor the
location from which you access the site and to block cash
gaming for any Jurisdiction at any time without prejudice.
17.4 Current nominated non-gaming jurisdictions:
- Australia
- Netherlands
- United States of America
- Turkey
17.5 Players residing in other jurisdictions must satisfy
themselves of the legality of their:
- Placement of Internet bets
- Depositing funds to their Player account
- Receiving funds

18.
Limitation of Liability
|
|
18.1
AusVegas shall not be liable for any:
- punitive, special, exemplary, incidental, consequential,
direct or indirect damage; or
- damage for loss of profits, business interruption, loss
of use of, or inability to use, the site including information
or transactions provided or downloaded from the site,
or any delay of such information or service, even if AusVegas or its authorized representatives have been advised
of the possibility of such damage, or any claim attributable
to errors, omissions or other inaccuracies in the service
and/or materials or information downloaded through the
site.
18.2 Malfunctions of any sort (software or hardware) voids
Play. AusVegas will not be liable for any alleged
winnings that are, in our sole discretion, the result
of a system error or malfunction.
You
agree to indemnify AusVegas, its parent, subsidiaries
and other affiliated companies, and their officers, directors,
employees, agents, licensors, suppliers and any third
party information and/or payment providers to the site
from and against all losses, expenses, damages and costs,
including reasonable legal costs, arising out of your
use or misuse of this site or from any violation of this
Agreement.

20.
Choice of Law and Forum
|
|
These
Terms shall be governed by and construed in accordance
with the laws of the Northern Territory of Australia.
You expressly agree that the exclusive jurisdiction for
any claim or action arising out of or relating to these
Terms, the Privacy
Policy or your use of this site shall be filed
only in the courts located in the Northern Territory of
Australia, and you further agree and submit to the exercise
of personal jurisdiction of such courts for the purpose
of litigating any such claim or action.
21.1
AusVegas' failure to enforce strict performance
of a provision of this Agreement shall not be construed
as a waiver of any provision or right. AusVegas
reserves the right to assign its rights and duties under
this Agreement to any party at any time without notice.
21.2 AusVegas' failure to act with respect to
a breach by you or others does not waive its right to
act with respect to subsequent or similar breaches.
